3. About Our Products and Condition Disclosure
Home Fixtures Outlet sells genuine, brand name home fixtures sourced through legitimate channels including manufacturer overstock, retailer returns, open-box inventory, and discontinued lines. Items are not new in the traditional retail sense unless specifically described as such.
Each product listing identifies its condition (for example, "open-box," "like new," "customer return," or "scratch and dent"). While our team inspects every product for functionality and cosmetic quality before listing, items may show minor signs of handling, may be missing original packaging or non essential accessories, and may not include the original manufacturer documentation.
Discounts of 50 to 80 percent off original retail are based on the manufacturer's suggested retail price or comparable new retail price at the time of listing. Such pricing references are provided for comparison purposes and do not represent a guarantee that the item was previously sold at that price by Home Fixtures Outlet.
4. Independent Reseller Status, No Brand Affiliation, and No Manufacturer Warranty
Home Fixtures Outlet is an independent secondary-market reseller. We are not an authorized or official reseller, dealer, distributor, agent, representative, partner, or affiliate of any brand or manufacturer whose products we sell. No statement, image, or product listing on this Site should be interpreted as suggesting endorsement, sponsorship, certification, or any other commercial relationship with the brands or manufacturers of the products offered.
Home Fixtures Outlet does not offer, transfer, extend, or honor any manufacturer warranty on any product sold through this Site. Because our inventory is sourced through secondary channels such as overstock, customer returns, open-box stock, and discontinued lines, any original manufacturer warranty either does not apply, has been voided by the secondary sale, or is otherwise unavailable. Customers should not contact the original manufacturer for warranty service, technical support, replacement parts, or returns on items purchased from us; such requests will generally be declined by the manufacturer because we are not an authorized seller and the product was not purchased through an authorized channel.
All sales are final. Our sole responsibility with respect to any product sold through this Site is limited to the limited remedy described in Section 8 and in our Refund and Return Policy, which applies only to items that arrive damaged, defective, or incorrect and that are reported to us promptly upon receipt as required by that policy. We assume no other obligation, liability, or responsibility of any kind in connection with the products, including but not limited to long-term performance, durability, compatibility, parts availability, technical support, repair, replacement, buyer's remorse, fit, style preference, or any consequential matter arising from ownership or use of the product.
5. Use of Third Party Trademarks
All brand names, trademarks, service marks, logos, and trade dress referenced or displayed on the Site are the property of their respective owners. Such marks are used solely to identify the manufacturer or origin of the genuine products we resell, in accordance with the doctrine of nominative fair use. Their appearance on the Site does not indicate, and shall not be construed as indicating, any sponsorship, endorsement, authorization, or affiliation between Home Fixtures Outlet and the trademark owner.
6. Intellectual Property of Home Fixtures Outlet
All original content on this Site, including text, graphics, logos, product photography taken by us, icons, audio, video, data compilations, and software, is the property of Plenus Real Estate Development LLC and is protected by United States and international intellectual property laws.
The Home Fixtures Outlet name and logo are trademarks of Plenus Real Estate Development LLC. You may not use these marks without our prior written permission.
No part of this Site may be reproduced, distributed, modified, transmitted, or used for commercial purposes without our prior written consent.
7. Product Availability and Pricing
Inventory described on the Site is typically one-of-a-kind or extremely limited. Once an item is sold, it generally cannot be replaced with identical stock. We reserve the right to cancel orders in the event of pricing errors, stock discrepancies, fraud, or any other circumstance that would make fulfillment unreasonable. In such cases, any payment received will be refunded in full.
Product images are representative. Due to the nature of open-box and returned inventory, the specific unit shipped may show variations not visible in stock photography. Where condition affects appearance, we make reasonable efforts to disclose this in the listing.
8. Limited Remedy, Disclaimer of Warranties, and Limitation of Liability
All products are sold "AS IS" and "WITH ALL FAULTS," and all sales are final. To the fullest extent permitted by applicable law, Plenus Real Estate Development LLC, doing business as Home Fixtures Outlet, expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement. No manufacturer warranty applies to any product sold through this Site. No oral or written advice given by Home Fixtures Outlet or its representatives shall create a warranty.
Sole and Exclusive Remedy. Your sole and exclusive remedy against Plenus Real Estate Development LLC is limited to a refund or replacement, at our discretion, for items that arrive damaged, defective, or incorrect, and only when reported in accordance with our Refund and Return Policy. Customers are required to inspect items immediately upon receipt (or, for warehouse pickups, before leaving our premises) and to notify us of any damage, defect, or fulfillment error without delay. Approval of any return is at our discretion based on the evidence provided and the conditions set out in the Refund and Return Policy. We do not accept returns for buyer's remorse, incorrect fit or style, change of mind, dissatisfaction with the level of open-box wear that was disclosed at the time of sale, or any other reason outside of damage, defect, or fulfillment error.
Inspection at Receipt. Failure to inspect items immediately upon receipt (or before leaving our premises in the case of warehouse pickups) and to report any damage, defect, or fulfillment error promptly may, at our discretion, result in denial of the limited remedy described above.
Installation and Code Compliance. Customers are solely responsible for verifying that any fixture purchased is appropriate for their intended use, that installation is performed by a qualified, licensed professional where required, and that all applicable building, plumbing, electrical, and safety codes and permits are observed. Home Fixtures Outlet is not liable for damages, losses, or injuries arising from improper installation, use outside manufacturer specifications, or failure to comply with applicable codes. Once a product has been installed, modified, or used, it is no longer eligible for return or refund.
Limitation of Liability. To the fullest extent permitted by law, Plenus Real Estate Development LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Site or the products purchased through it, including but not limited to property damage, water damage, electrical damage, installation costs, labor costs, lost time, or loss of use. Where liability cannot be excluded under applicable law, our total aggregate liability for any claim shall not exceed the amount paid by the customer for the specific product giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such jurisdictions, the above limitations apply to the maximum extent permitted by law.

10. Governing Law and Jurisdiction

Any dispute arising out of or relating to this Site or any purchase made through it shall be subject to the exclusive jurisdiction of the state and federal courts located in Montgomery County, Texas.

This Legal Notice supplements and should be read together with our Terms of Service, Privacy Policy, Refund and Return Policy, and Shipping Policy, each of which is available at homefixturesoutlet.com and is incorporated by reference into this Legal Notice. In the event of any conflict between this Legal Notice and any other policy specifically addressing the subject matter at issue, the more specific policy shall control, except (a) with respect to Section 4 (Independent Reseller Status, No Brand Affiliation, and No Manufacturer Warranty) and Section 5 (Use of Third Party Trademarks), which shall control regardless of any contrary language elsewhere, and (b) with respect to the processing of personal information, where our Privacy Policy controls.
